These Terms of Use govern your access to and use of the WillProof website and service. By using WillProof, you agree to these terms.

1. The service

WillProof is an AI-powered quality control tool for Will proofing. It analyses uploaded Will documents and produces structured proofing reports highlighting errors, queries, and verifications.

2. Not legal advice

WillProof is a quality control tool, not a legal advisor. Reports produced by WillProof do not constitute legal advice. The final decision on every Will always rests with a qualified legal professional. You are solely responsible for all legal decisions made in relation to Wills proofed using our service.

3. Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorised use.

4. Acceptable use

You agree to use WillProof only for lawful purposes related to Will proofing. You must not:

  • Attempt to reverse-engineer, copy, or replicate the WillProof system or its prompts.
  • Upload malicious files or content designed to exploit the system.
  • Share your account credentials with unauthorised persons.
  • Use the service in any way that violates applicable laws or regulations.

5. Fair use policy

Each WillProof credit is intended for a single Will matter (one Will, or a pair of mirror Wills). To ensure the quality and reliability of the service:

  • Individual documents should not exceed 50 pages or 5MB per file.
  • A single Will matter (all documents combined) should not exceed 100 pages total.
  • Uploading excessively large or irrelevant documents that cause disproportionate processing costs may result in the proof being rejected or your account being reviewed.
  • We reserve the right to limit or suspend accounts that consistently exceed fair use thresholds.

6. Document quality and accuracy

The accuracy of WillProof reports depends on the quality and legibility of the documents you upload.

  • Typed documents (PDF and Word) typically provide the most reliable results, as text can be extracted directly.
  • Scanned documents are supported and will be analysed using image recognition. Low-resolution scans, poor contrast, or faded ink may reduce accuracy.
  • Handwritten documents are supported but may be subject to reduced accuracy. Handwriting varies significantly in legibility, and our AI engine may misread, misinterpret, or be unable to recognise certain words or passages. This can affect the completeness and accuracy of the proofing report.

You acknowledge that proofing reports generated from scanned or handwritten documents may contain additional errors arising from the interpretation of the source material. All findings must be independently verified by a qualified legal professional, with particular care given to any documents that were submitted in handwritten or scanned form.

7. AI data processing

WillProof uses an AI service provider (currently Anthropic, PBC, referred to as our “AI Provider”) to analyse uploaded Will documents and generate proofing reports. By using WillProof, you acknowledge and agree to the following:

  • Document transmission: When you submit a Will for proofing, the document contents are transmitted securely to our AI Provider for analysis. All data is encrypted in transit (via HTTPS/TLS) and is not stored by the AI Provider after processing is complete.
  • Processing location: Document contents are processed in the United States. This transfer is conducted under the UK–US Data Bridge framework, which provides an adequate level of data protection as recognised by the UK Government.
  • No AI training: Your documents are never used to train, fine-tune, or improve AI models. Our AI Provider’s commercial API terms expressly prohibit the use of customer data for model training.
  • Data processing terms: Our AI Provider’s standard commercial API terms incorporate data processing provisions which govern the handling of data submitted through the service. We rely upon these standard terms rather than a separately negotiated data processing agreement. Details of these provisions are available upon request.
  • Purpose limitation: Document contents are submitted to our AI Provider solely for the purpose of generating your proofing report. No other use is made of your data by our AI Provider.

We may change our AI Provider from time to time. Any replacement provider will be subject to equivalent or stronger data protection commitments, and we will update this section accordingly.

8. Intellectual property and data ownership

All content, design, and technology of the WillProof platform (including system prompts, report templates, and the underlying software) remain the property of Destiny Wills & Legal Services Ltd.

You retain full ownership of all documents you upload to WillProof and all proofing reports generated from those documents. WillProof does not claim any ownership rights over your data.

By using the service, you grant WillProof a limited, non-exclusive licence to process your documents solely for the purpose of delivering the proofing service. This licence terminates when your documents are deleted from the platform.

9. Limitation of liability

WillProof is provided “as is”. While we strive for accuracy, we do not guarantee that AI-generated reports will be free from errors or omissions. To the fullest extent permitted by law, Destiny Wills & Legal Services Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

10. Availability

We aim to keep WillProof available at all times but do not guarantee uninterrupted access. We may carry out maintenance or updates that temporarily affect availability.

11. Changes to terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
